Welcome to Oyays. These Terms of Use ("Terms") govern your access to and use of the website oyays.com and the Daily Prize Drop sweepstakes (collectively, the "Service") operated by Oyays LLC ("Oyays," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age and a legal resident of the United States to participate in the sweepstakes and be eligible to win prizes. By using the Service, you represent and warrant that you meet these requirements. Users outside the United States may access the Site but are not eligible to receive prizes.

2. The Sweepstakes

The Daily Prize Drop is a free sweepstakes — not a gambling product, lottery, or game of skill. No purchase is necessary to enter or win. A purchase would not improve your chances of winning. Participation is governed by the Official Rules, which are incorporated into these Terms by reference.

3. Acceptable Use

When using the Service, you agree that you will not:

  • Use bots, scripts, macros, or any automated tools to spin or interact with the Service.
  • Attempt to reverse-engineer, decompile, or scrape the Service or its underlying systems.
  • Attempt to interfere with, overload, or disrupt the Service (e.g., denial-of-service attacks).
  • Impersonate another person or submit false information in a prize claim.
  • Create multiple accounts to circumvent entry limits.
  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to manipulate, exploit, or circumvent the provably-fair random number system.

Violation of these rules will result in immediate disqualification, account termination, and forfeiture of any prizes. We reserve the right to report fraudulent activity to law enforcement.

4. Intellectual Property

All content on the Site — including text, graphics, logos, and software — is owned by or licensed to Oyays LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission. Needoh® is a registered trademark of Schylling, Inc.; Oyays is not affiliated with Schylling, Inc.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@oyays.com if you suspect unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Service is at your sole risk.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OYAYS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF $10.00 OR THE FAIR MARKET VALUE OF ANY PRIZE YOU ACTUALLY RECEIVED FROM US.

8. Disqualification

We reserve the right to invalidate any entry obtained through fraud, bot activity, multiple accounts, or any other prohibited means, and to refuse to award any prize tied to such an entry. Decisions by Oyays regarding disqualification are final.

9. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

10. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

11. Governing Law & Disputes

These Terms are governed by the laws of the State of New York, excluding conflicts of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts.
